Halloween Horror Nights Rules
MARC RADIO GROUP GENERAL CONTEST RULES
NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.
Note: These rules cover daily contests for Radio Stations WTMG-FM, WHHZ-FM, WXJZ-FM, WPLL-FM, WDVH-AM, WTMN-AM, and WRZN-AM (the “Stations”). These rules may be superseded by separate specific rules for major contests conducted by the Station or its sponsors.
1. HOW TO ENTER THE CONTEST:
a. The contest or promotion (the “Contest”) will take place during the dates and times specified in the official rules of the Contest. The Stations may change the dates and/or terms of the Contest without prior notice. Any material changes will be broadcast on the Stations and/or posted on the Stations’ individual websites. ·
b. To be eligible to enter, listeners must follow the instructions set forth in the rules of the
Contest and must fulfill all of the eligibility requirements of the Contest.
c. Contest-specific rules shall be made available at the offices of MARC Radio Gainesville, LLC, 100 NW 76TH Drive, Suite 2, Gainesville, FL 32607.
d. Listen weekdays during the “60 minute buzz” in the 7AM & 4PM hours. Radio station will solicit for a certain caller number, as stated by on-air talent. Once caller number is established, they win the prize.
2. ELIGIBILITY RESTRICTIONS:
a. Unless otherwise specified, the Contest is open to all listeners of the Stations who are 18 years of age or older and who legally reside in the Greater North Central Florida Area. The “Greater North Central Florida Area” described above and further referenced herein shall be strictly limited to the geographic area encompassed by the following counties in the state of Florida: Alachua; Marion; Gilchrist; Levy; Citrus; Dixie; Lafayette; Putman; Suwannee; Bradford; Sumter; Union; Columbia. Employees of the Stations, the Stations’ licensee, corporate parents, subsidiaries and affiliates, advertising agencies, participating sponsors/promotional partners, Universal City Development Partners, Ltd. d/b/a Universal Orlando Resort (“Universal Orlando”), other radio stations in the Greater North Central Florida Area and the members of the employees’ immediate families and/or households are ineligible to participate or win.
b. Winners must waive any and all claims of liability against the Stations and MARC Radio Gainesville, LLC and its affiliates and respective employees and agents for any personal injury or loss which may occur from participation in this contest or from the use of the prize. If a listener provides any misinformation about their identity when entering the Contest, then the listener shall be hereby ineligible to participate in any future Contest conducted by the Stations or become a winner for two (2) calendar years from the date the misinformation was provided.
c. Only one winner per household or per address may win a contest every thirty (30) days on each of the Stations, or sixty (60) days if the value of the prize is equal to or greater than $75.00 USD. Only one winner per household or address is permitted in any Contest. Each winning Contestant may only win in his or her own name. A household includes any persons living at or using the same address.
d. By winning a prize valued at $600.00 USD or more, the winning Contestant becomes ineligible for one (1) calendar year from the date of winning to win any prize on any of the Stations. If a winner wins more than $600.00 in cumulative prizes through one (1) calendar year, the winner may receive a 1099 Tax Form.
**NOTE: Contest rules may change without notice due to unforeseen circumstances.
a. Contest prizes and values will be indicated in the rules of the Contest.
b. Unless otherwise indicated in the rules of the Contest, all prizes or prize certificates may be picked up at the office of MARC Radio Gainesville, LLC, 100 NW 76th Drive, Suite 2, Gainesville, Florida 32607. Prizes may be claimed during regular business hours (between 9:00am and 5:00pm, Monday through Friday). Contest winner(s) will be required to present valid government-issued photo identification and provide their address, phone number, and Social Security number to claim a prize. Unless otherwise permitted by the Station, winners must claim their prizes in person, and prizes cannot be claimed by third parties on behalf of winners. Failure to comply with these requirements will result in the forfeiture of the prize. The winner will forfeit any prize or prize certificate not claimed within fifteen (15) days of winning. No alternate winner will be selected and the prize will become the property of MARC Radio Gainesville, LLC. If a prize or prize certificate is not available at the time that the winner arrives to claim the prize, the Stations, solely in the Stations’ discretion, may opt to mail the prize to the winner. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. Neither MARC Radio Gainesville, LLC nor MARC Radio Gainesville, LLC’s and the Stations’ licensees, corporate parents, subsidiaries and affiliates, advertising agencies, and participating sponsors/promotional partners are responsible for the safe arrival of a prize or prize certificate.
c. There is no substitution, transfer, or cash equivalent for prizes, except that Contest
Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed in the rules of the Contest and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
There will be Thirty (30) Prizes (each a “Prize”) awarded.
Each Prize winner (“Winner”) will receive:
Universal Orlando Halloween Horror Nights Single Night tickets for Winner and up to one (1) Guest.
Universal Orlando Resort 1-Day Regularl Parking access for one (1) vehicle.
The prize has an approximate Fair Market Value (“FMV”) of One Hundred Eighty-Two and 98/100 Dollars ($182.98) and must be used by November 2, 2019 or the prize will be forfeited. Block out dates or restrictions may apply. If Winner elects to partake in any or all portions of the Prize with no guest, the Prize will be awarded to Winner only and any remainder of the Prize will be forfeited and shall not be subject to further or alternative compensation. All elements of the prize must be redeemed at the same time, and no changes will be permitted after confirmation of any redemption. Winner must be eighteen (18) years of age or older. Minor guests, if any, must be accompanied by a parent or legal guardian. Please note that the Halloween Horror Nights event may be too intense for young children and is not recommended for children under the age of thirteen (13). No costumes or masks are allowed. Prizes are non-transferable and have no cash value. Any difference between stated FMV and final FMV of prize will not be awarded. Prize consists only of the elements expressly set forth above; no other elements or expenses (including, without limitation, air travel, insurance, meals, unspecified ground transportation, phone calls, baggage, gratuities, incidentals, souvenirs, gasoline, etc.) are included in the prize and all such expenses are the sole responsibility of the winner. Theme park tickets are valid during normal operating hours only. Operating hours and availability of attractions and shows are subject to change without notice. Some special events may be separately ticketed. Universal Orlando reserves the right to change the name of all tickets. Unless otherwise indicated, all tickets specifically exclude admission to special or separately ticketed “hard ticket” entertainment events at any of the theme parks, hotels, or within any of the Universal CityWalk venues such as Hard Rock Live® and the Blue Man Group show.
Universal City Development Partners, Ltd. d/b/a Universal Orlando Resort (“Universal Orlando”) is a prize supplier only in this promotion, is not a sponsor of this promotion and is not responsible for the administration of the promotion, the collection of entries, or the selection of any winner. Any disputes, claims, and causes of action against Universal Orlando arising out of or relating to any person’s use of or participation in any prize provided by Universal Orlando shall be resolved by applying the laws of Florida, without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in state or federal courts within Orange County, Florida. Such claims shall be resolved individually, without resort to any form of class action, and all such claims shall be limited to actual out-of-pocket costs incurred, but in no event to include attorneys’ fees.
4. SELECTION OF WINNERS:
a. Decisions of the Stations’ management with respect to the Contest are final.
b. Contest winners will be selected and notified of their prize in the manner described in the rules of the Contest.
a. Payments of all federal, state and local taxes are the sole responsibility of the winner. Winners may be required to sign an IRS Form W-9 or the equivalent.
b. By participating in the Contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material related to this contest, without further compensation, and, where permitted by law, sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station in their sole discretion may require Contest winners, and their travel companions, if any, to sign a liability release, agreeing to hold the Stations, their corporate licensees, their parents, subsidiaries and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of the Stations harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Contest.
d. The Stations are not responsible for (i) show cancellations, lost, stolen, mangled, undelivered, postage due, illegible, incomplete or late entries; (ii) telephone service outages, delays, busy signals, facsimile transmission errors, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call or entering the contest.
e. The Stations reserve the right to make changes in the rules of the Contest, including the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Stations, a prize-related event is delayed, rescheduled, postponed or cancelled, the Stations reserve the right, but not the obligation, to cancel or modify the Contest and shall not be required to award a substitute prize.
f. Failure to comply with the rules of the Contest may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If the Station makes a good faith determination that a listener has cheated or committed fraudulent activity in connection with a Contest, the Station reserves the right to disqualify that listener from entering and/or winning future Contests.
g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest, or in the announcement of a prize.
h. Due to the time delay that exists between the Station’s over the air signal and the Station’s online streaming, listeners who listen to the Station’s online signal may hear the cue to call later then listeners listening to the Station’s analog over the air signal. As a result, the odds of a digital or online listener becoming a contestant are diminished. The Stations are not responsible for any such diminished chances of becoming a contestant or the results thereof.
i. Copies of the written contest rules are available during regular business hours at the main studios of MARC Radio Gainesville, LLC, 100 NW 76th Drive, Suite 2, Gainesville, Florida 32607.
6. VENUE AND JURISDICTION:
This agreement shall be governed by the laws of the state of Florida. The exclusive venue and jurisdiction for any action brought pursuant to this Agreement shall be the Circuit Court of the Eight Judicial Circuit in and for Alachua County, Florida. MARC Radio Gainesville, LLC, the Stations, and any and all contestants waive all other jurisdiction and venue and specifically consent to this jurisdiction and venue.
